FallAI TERMS OF USE AND SERVICE AGREEMENT

1. PARTIES AND ACCEPTANCE

This Terms of Use Agreement ("Agreement") is concluded between the real person ("User") who downloads and uses the mobile application named FallAI ("Application") and Mustafa Tosun ("Developer"), the legal owner and developer of the application. By installing and using the Application on their device, the User declares that they have read, understood, and accepted all the terms contained in this Agreement. If you do not accept the terms, please do not use the Application and delete it from your device.

2. SCOPE OF SERVICES AND ENTERTAINMENT DISCLAIMER

2.1. FallAI is a platform that generates entertainment-oriented content such as Turkish coffee cup reading, tarot, dream interpretation, face analysis, horoscope comments, daily fortune cookies, and a virtual wishing tree using artificial intelligence technologies.

2.2. ATTENTION: All analyses, fortunes, comments, predictions, and responses provided within the Application are SOLELY FOR ENTERTAINMENT PURPOSES.

2.3. No content generated by the Application constitutes scientific, medical, legal, psychological, financial, or professional advice, and does not reflect reality.

2.4. The Developer shall under no circumstances be held liable for any decisions made by the User or any material/moral damages experienced based on the comments, fortunes, or analyses within the Application.

3. FACE ANALYSIS AND USER CONTENT

3.1. The Application may request the User to upload a photo or grant camera access for face analysis and coffee cup reading features.

3.2. The User accepts that the photos uploaded to the Application are uploaded with their own consent, and they will not use private or copyrighted images belonging to others without permission.

3.3. Details regarding the processing and storage of uploaded photos are separately regulated in the "Privacy Policy".

4. AGE LIMIT

This Application is inherently designed for users aged 18 and over. By using the Application, you represent that you are over 18 years of age or under the supervision and permission of your legal guardian.

5. IN-APP PURCHASES AND SUBSCRIPTIONS

5.1. Subscriptions or in-app purchases may be required to unlock certain features within the Application, remove advertisements, or earn monthly fortune/analysis credits.

5.2. All payment transactions, subscription initiation, renewal, and cancellation processes are carried out entirely through the Apple App Store or Google Play Store infrastructure. The Developer never sees or stores your credit card or payment information.

5.3. Subscription cancellations must legally be made by the user through the account settings of the relevant store (Apple/Google). Deleting the application from the device does not automatically cancel the subscription. Since purchased digital content and credits are delivered instantly, refund processes are entirely subject to the refund policies of the relevant store (Apple/Google).

6. LIMITATION OF LIABILITY AND TECHNICAL INFRASTRUCTURE

6.1. The Application uses third-party service providers (e.g., Google Firebase and various AI APIs) for infrastructure services. The Developer does not guarantee that the Application will operate uninterrupted, error-free, or securely.

6.2. The Developer is not responsible for situations that may occur due to server crashes, data loss, internet connection problems, disruptions caused by ad networks, or irrational/erroneous texts generated by AI services.

7. INTELLECTUAL PROPERTY RIGHTS

All design, software codes, interface, logos, and original texts generated by the Application belong to the Developer. The User cannot copy, reverse engineer, modify, or use the Application without permission for commercial purposes.

8. USER CONDUCT AND PROHIBITED USES

8.1. The User agrees not to use the Application for any unlawful, misleading, or malicious purposes.

8.2. Strictly Prohibited: Uploading, sharing, or processing photos containing nudity, violence, illegal acts, abuse, or content that violates the intellectual property or privacy rights of third parties.

8.3. The User shall not attempt to reverse-engineer, disrupt, or overload the Application's servers, AI APIs, or technical infrastructure.

9. DISCLAIMER OF WARRANTIES

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE DEVELOPER DISCLAIMS ALL WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE AI-GENERATED CONTENT. YOUR USE OF THE APPLICATION IS AT YOUR SOLE RISK.

10. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts and execution offices of Istanbul, Turkey.

11. CHANGES

The Developer reserves the right to change these Terms of Use at any time without prior notice. Changes come into force as soon as they are published within the Application. Your continued use of the Application means that you accept the changes.

FallAI PRIVACY POLICY

This Privacy Policy explains how personal data of users is collected, processed, stored, and transferred by FallAI ("Application") in accordance with global data protection regulations (GDPR, CCPA, etc.) and local legislation.

1. DATA CONTROLLER

The Data Controller for your personal data collected within the scope of the Application is Mustafa Tosun. Contact information is located at the end of the document.

2. COLLECTED DATA AND PURPOSES OF PROCESSING

The Application processes the following data to provide you with AI-based entertainment and analysis services:

• Device and Usage Information: Device model, operating system version, unique device identifiers (IDs), and your in-app interaction data. This data is processed through the Firebase infrastructure to improve the performance of the application and perform analytical reviews.
• Advertising and Analytics Data: Device advertising identifiers (Google Advertising ID or Apple IDFA) may be processed by third-party ad networks for the presentation and personalization of advertisements within the application.
• Visual Data (Photos):
• - Face Analysis: When you use the face analysis feature, the local path of the photo you upload on your device is saved to the Firestore database. Your photos are not permanently stored on our servers (Firebase Storage). The photo is processed instantly via AI APIs and presented to you as an analysis result. No biometric data or facial recognition data is stored. Your data is temporarily transferred to third-party AI service providers solely for analysis purposes, and these providers process the data in accordance with their own privacy policies.
• - Coffee Cup Reading: The local path of the photos you upload for coffee cup reading is saved to the Firestore database to be viewable in your processing history. In the future, to improve user experience, the coffee photos you submit may be securely stored on our cloud servers (Firebase Storage) with your permission.
• Device Permissions:
• - Camera and Photo Library: We request access to your device's camera and photo gallery to allow you to take and upload photos for analysis. With your permission, we also save the generated images or taken photos back to your device's photo gallery.
• - We do not access or collect any files or photos from your device other than those you explicitly select and upload.

3. TRANSFER OF PERSONAL DATA AND INTERNATIONAL TRANSFER

3.1. Google Firebase and third-party ad networks (e.g., Google AdMob) are used for the database, analytical data tracking, ad display, and infrastructure management processes of our application. In addition, Apple and Google services are involved for the payment infrastructure.

3.2. To perform AI analyses (fortune telling, face analysis, dream interpretation, etc.), relevant text and visual inputs are temporarily transferred to the servers of third-party AI service providers (Google Gemini, OpenAI and/or other secure AI API providers that may be integrated in the future). These service providers process data solely for the purpose of performing the analysis in accordance with their own privacy policies.

3.3. International Transfer: The servers of Google Firebase, ad networks, and AI API providers can be located outside of your local region. Accordingly, the data you share using the Application is transferred to and processed on secure servers abroad. By using the application and approving this policy, you explicitly consent to the transfer of your data abroad.

4. DATA RETENTION PERIOD

Your personal data is stored as long as you continue to use the Application or for the period required by legal obligations due to the nature of the service. Visuals used instantly for analysis purposes are processed on the server side as soon as the analysis is completed and are not permanently retained.

5. USER RIGHTS (GDPR / GLOBAL)

Depending on your location, you have the following rights regarding your personal data:

• Right to access your personal data,
• Right to request correction of inaccurate data,
• Right to request erasure of your data ("Right to be forgotten"),
• Right to restrict or object to the processing of your data,
• Right to data portability.

6. CHILDREN'S PRIVACY

The Application is not intended for use by children under the age of 18 (or the legal age limit in your jurisdiction).
